    1. INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA FOR OUR OWN BUSINESS PURPOSES

 

      1. Purpose and legal grounds of the data processing

We collect and process your personal data for the following purposes:

 

Applicant data

We collect and process applicant data for the purpose of conducting application procedures, to the extent necessary for the decision to establish an employment relationship with us. In that case, Art. 88 GDPR in conjunction with Section 26 (1) and Section 8 (2) of the Federal Data Protection Act [BDSG] shall constitute the legal grounds.

If we hire applicants, we can process their personal data in accordance with Section 26 (1) of the Federal Data Protection Act [BDSG] insofar as this is necessary for the purposes of the employment relationship.

We store the data of unsuccessful applicants for the possible defence against asserted legal claims from the application process of up to 6 months after receipt of rejection in writing in accordance with Art. 6 (1) (f) GDPR. Our legitimate interest in this relation is a burden of proof in a procedure under the General Equal Treatment Act (AGG). Any further storage will only take place with the express consent of the applicant.

 

Processing of personal data in the online shop and our stores

        • For preparing a quotation (initiation of a purchase contract) as well as for concluding and executing of purchase contracts and orders. The processing is based on Article 6 (1) (b) GDPR, which allows the processing (including transmission) of data for performance of the contract.
        • In the event of hire purchase, also for the execution of loan inquiries and the drafting of loan agreements, on behalf of a lending bank, if applicable. The processing is exclusively based on your consent in accordance with Art. 6 (1) (a) GDPR. As part of granting loans, we will - upon your prior consent - obtain credit reports based on mathematical and statistical procedures using your address details.
        • Verification of your address to check for deliverability. For this purpose, we will send your full name, address and, if applicable, your date of birth to infoscore Consumer Data GmbH, Rheinstraße 99, 76532 Baden-Baden. In the future, infoscore Consumer Data GmbH will also use the data for verifying address or identity vis-a-vis other companies as well as for corresponding scoring applications.
        • We also process personal data for carrying out promotions and prize draws. The processing is based on your consent in accordance with Article 6 (1) (a) GDPR. Once the promotion is completed, the relevant data you submit to us will be erased, unless otherwise provided for by the statutory or contractual retention requirements.
        • We can also use the addresses of our existing customers for postal advertising of our offer brochures, catalogues and the like. The processing is based on Article 6 (1) (f) GDPR. Our legitimate interest is personal direct advertising. You are entitled to object to the use of your data for the purpose of direct advertising at any time.
        • For advertising via e-mail in the form of offers, reminders about uncompleted shopping carts and the like, we use the e-mail addresses of our existing customers, i.e. only those already engaged in a business relationship with us. The processing is based on Article 6 (1) (f) GDPR in conjunction with Article 7 (3) UWG (German Unfair Competition Act). Our legitimate interest lies in the simple and favourable advertising approach of the existing customers and the improvement of their shopping experience. Of course, in compliance with the stringent requirements set out in Section 7 (3) UWG (German Unfair Competition Act), which authorises the use of the e-mail address of the existing customers under certain conditions. You are entitled to object to the use of your e-mail address for these purposes at any time.

 

      1. Data transmission

The personal data collected by us will be transmitted to third parties only as far as necessary for contract fulfillment, e.g. the transport company commissioned with the delivery of goods or the financial institution commissioned with payment processing. No further data is transmitted unless you have expressly agreed to the transmission. No personal data will be passed on to third parties for advertising purposes, etc. without your explicit consent. The legal basis for data processing is Art. 6 para. 1 (b) GDPR, which allows the processing of data to fulfill a contract or for pre-contractual measures.

 

      1. Data storage

Your personal data will only be stored for as long as it is required for contractual or other purposes for which it was collected or if there are statutory or contractual provisions on retention. Statutory retention periods are determined, among other things, in accordance with provisions relating to social and tax laws, and range up to ten years for tax-relevant documents and items.

 

      1. Automated decision-making

For the deliveries on account, bank collection or for financing purposes, we will check creditworthiness information for German and Austrian customers with SCHUFA Holding AG, Kormoran Weg 5, 65201 Wiesbaden, or at infoscore consumer data GmbH, Rheinstr. 99, 76532 Baden-Baden. The processing is required for the fulfilment of the contract and is based on Article 6 (1) (f) in conjunction with Article 22 (2) GDPR

We expressly note that we collect or use probability values regarding your future conduct within the scope of risk control for decision making purposes, such as regarding the conclusion, implementation or termination of this contractual relationship. Address data is also used for the calculation of these probability values. The processing is based on Section 31 (1) of the Federal Data Protection Act [BDSG] (new).

      1. Recipient

Only our company's employees, who are responsible for the technical administration, maintenance and further development of the website, have access to your personal data.

Should you contact us, employees responsible for handling the relevant procedure will also have access to your personal data. In addition, to maintain our IT systems, we commission external IT service providers who may be able to gain access to your personal data as part of implementing their professional activities. The same applies to hosting providers.

We require your personal data to enable the use of the website and to process your order, a newsletter or contact request. You may refrain from providing your personal data or to provide us with incomplete data. In that case, however, you might be unable to use all the features of the website, or participate in promotional contests or competitions, or purchase our products online.

      1. Processing data in the online shop (customer and contract data)

We only collect, process and use person-related data about the use of our websites (usage data) insofar it is necessary for enabling or invoicing the use of the service.

The customer data collected will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

 

      1. Payment service provider

Paypal

Our website, among other things, offers payment opportunity via PayPal. The payment service provider is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal"). If you choose to pay via PayPal, the payment details you enter will be passed on to PayPal. The transmission of your data to PayPal is based on Art. 6 (1) (a) GDPR (consent) and Art. 6 (1) (b) GDPR (processing to fulfil a contract). You can revoke your consent to data processing at any time. It does not affect the processing of data previously collected.

 

Mastercard

We use Mastercard for payment processing www.mastercard.de/de-de/datenschutz.html . The processing takes place for fulfilment of the contract based on Article 6 (1) (b) GDPR. The data processed here include name, address, bank details, credit card numbers, passwords, as well as the contract, totals and recipient-related data. These data is required to complete transactions. The data, however, will only be processed and stored by Mastercard. We do not receive any personal information, but only feedback about the confirmation or rejection of the payment. Mastercard may pass on the data to credit reporting agencies for identity and credit verification. For this purpose, we refer to the terms and conditions and privacy policy of Mastercard. The terms and conditions and the data protection instructions of Mastercard apply. These are available at www.mastercard.de.

 

      1. Newsletter

If you would like to receive our newsletter, we will need an e-mail address from you, which you can submit to us via the newsletter registration. We will verify your email address as part of the double opt-in process. We will send you our regular newsletter after confirmation of our first opt-in e-mail. No additional data is collected or is only collected on a voluntary basis. We will use this data exclusively for sending the newsletter. The processing takes place exclusively on the basis of your consent in accordance with Art. 6 (1) (a) GDPR.

You can revoke your consent to the newsletter at any time, for example, via the Unsubscribe link in each newsletter or by e-mail to service(at)polo-motorrad.com. Should you have a customer account, you can also manage your Newsletter subscription within the "My POLO" area. The data processed before we receive your request may still be legally processed. The data provided when registering for the newsletter will be used to distribute the newsletter until you cancel your subscription. Once you have unsubscribed from the newsletter, we will delete your data from the newsletter mailing list. Data we have stored for other purposes (e.g. email addresses for the members area) remain unaffected.

When you subscribe to the POLO Newsletter, you provide your consent to POLO to use the data you provided, as well as personalized user data, in order for POLO to present to you personalized advertising and / or special offerings and services.

If you wish to no longer receive personalized advertising or the Newsletter from POLO, you may object to receiving personalized advertising or the Newsletter in general or to certain measures. Each Newsletter contains an Opt-Out link.

The processing is carried out on the basis of Article 6 (1) (f) GDPR, our legitimate interest would be an improved and more personalised design of our newsletter. At the same time, personalisation will also enhance your shopping experience, as we will mainly send you information that suits your preferences and interests. At the same time, we avoid randomly sharing unsolicited advertising with you.

 

      1. Contact forms

We offer various forms for data entry. Should you send us data via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. Your data will not be shared without your prior consent.

We will, therefore, process any data you enter onto the contact form only upon your prior consent as per Art. 6 (1) (a) GDPR. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Mandatory statutory provisions – especially those regarding mandatory data retention periods – remain unaffected by this provision.

 

      1. Use of Cookies

We use Cookies on our website. Cookies are text files that the browser stores on the hard drive. This data contains information on the Internet pages you visited and which advertising you have seen. In no event do Cookies facilitate the identification of personal data, such as e.g. name, address, e-mail address etc.

A Cookie is set for a period of 365 days, if you permanently store information on your bikes in our Bike database. The stored information on your bikes allows us to always display the fitting parts for your bike. In addition, we can use this Cookie to provide you with fitting offerings for your bike outside of the Webshop.

Cookies which are necessary to allow electronic communications or to provide certain functions you wish to use (such as the shopping cart) are stored pursuant to Art. 6 paragraph 1, letter f of DSGVO. We have a legitimate interest in the storage of cookies to ensure an optimised service provided free of technical errors. If other cookies (such as those used to analyse your surfing behaviour) are also stored, they will be treated separately in this privacy policy.

 

      1. Server log files / Log data

The website provider automatically collects and stores information that your browser automatically transmits to us in “server log files”. These include:

        • Browser type and browser version
        • Operating system used
        • Referrer URL
        • Host name of the accessing computer
        • Time of the server request
        • IP address

These data will not be combined with data from other sources.

The legal basis for data processing is Art. 6 para. 1 (b) GDPR, which allows the processing of data to fulfill a contract or for pre-contractual measures. However, we cannot use this data to identify individuals without any additional information such as information of an Internet provider about the subscriber, which is normally not available to us without any specific reason such as suspected legal violation.

Use of Econda Webtracking

We collect and store anonymized data based on econda GmbH solutions and technologies for the adequate design of our offerings, as well as the optimization of our website and all electronic and postal communication. Our legitimate interest in accordance with Article 6 (1) (f) GDPR is the analysis, optimisation and the economic interest in the design of our online shop.

Based on this data, user profiles are generated using pseudonyms. For this purpose Cookies are used that enable recognition of an Internet Browser. User profiles are, however, not matched with pseudonym data, unless the user provides his or her express consent. In particular IP addresses are made unrecognizable such that user profiles cannot be assigned to IP addresses.

By accepting our Cookie provisions, the user of this website declares his or her consent to matching the pseudonym to the collected data and generated profiles.

Users of this website may object to the future collection and storage of this data here. The objection only applies to the device and web browser in which the Opt-Out-Cookie is set. Please repeat this procedure for all other devices if necessary. If you delete the Opt-Out-Cookie then we will store your inquiries once again.

 

Use of Google Analytics website analytics

Based on our legitimate interest, in accordance with Article 6 (1) (f) GDPR (analysis, optimisation and economic interest in designing our online shop) we use Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called “Cookies”, text files which are stored on your computer and which allow an analysis of your use of the website. The information generated by the Cookie about your use of this website is generally transferred to and stored at a server of Google in the U.S. As IP anonymisation is activated on this website, your IP address from within the member states of the European Union or other members of the European Economic Area will be abbreviated. Only in exceptional cases will the full IP address be sent to a Google server in the USA and abbreviated there. Using the remarketing or "similar target group" feature by Google Inc.

Based on our legitimate interest, in accordance with Article 6 (1) (f) GDPR (analysis, optimisation and economic interest in designing our online shop) we use the remarketing feature by Google Inc. The purpose of this function is to present interest-related ads to web page visitors within the scope of the Google advertising network. A so-called cookie is stored in the web page visitor’s browser, by which a visitor can be recognized if such user accesses web pages that belong to Google’s advertising network. On these pages ads can be presented to visitors that relate to content that the visitor previously accessed on web pages that use the Remarketing Function of Google.

According to information provided by Google, Google does not collect personal data within the scope of this procedure. Should you nonetheless not want that Google’s Remarketing Function is used, you can generally deactivate this function by applying the respective settings at www.google.com/settings/ads . Alternatively, you can deactivate the use of cookies for interest-related advertising by following the instructions at www.networkadvertising.org/managing/opt_out.asp.

You can access additional information regarding Google remarketing, as well as the Google data protection statement at: www.google.com/privacy/ads/.

If users provided their consent that Google may link their web and application browser history with their Google account and that information contained in their Google account may be used to personalize advertising you see in the Internet, Google uses data of these logged-in users together with Google Analytics data to create and define target group lists for cross-device remarketing purposes. To support this function, Google Analytics collects the IDs of these users. These IDs are authenticated by Google. Google matches this person-related data with our Google Analytics data on a temporary basis to create target groups.

Google users may, as before, adjust their advertising settings in their account under My Account or completely deactivate personalized advertising.

 

      1. Usabilla feedback service

The site uses the Usabilla website feedback service by Usabilla B.V. (Amsterdam, The Netherlands) ("Usabilla") to collect feedback from users and improve the website.

If a user presses the feedback button displayed on the website or uses another form of feedback, cookies are placed on his or her computer and the user's browser establishes a direct connection to the Usabilla server. Usabilla collects data such as device, operating system, browser, screen resolution and stores it in a pseudonymised user profile. Further data such as e-mail address and feedback text will only be collected if a user actively indicates it. The cookie is not set until the user clicks on the corresponding button. The processing is based on your consent in accordance with Article 6 (1) (a) GDPR.

      1. AWIN-Partner Programme

Based on our justified interests (i.e. interest in the economic operation of our online offering in terms of Art. 6 Para 1 lit. f GDPR), we are participants in the partner programme of AWIN AG, Eichhornstra├če 3, 10785 Berlin, Germany, which was created for the provision of a medium for websites with which placing of advertisings and links to AWIN advertising cost reimbursement can be earned (so-called Affiliate System). AWIN uses cookies to trace the origin of a concluded agreement. AWIN can, among others, recognise that you clicked on the partner link on this website and subsequently concluded an agreement with or via AWIN. We use the services of third party advertising companies that collect information on visits to our and other web pages using so-called "DoubleClick DART Cookies" to be able to create personalized, user-related advertising for the visitors of our website. By employing this method, it is possible to better take the user's interests into account and offer the user advertising for products and services that correspond to the user's real interests. This method does not collect or use personal data such as name, address, e-mail address or telephone number; DART Cookies only contain the domain name which set the Cookie ("ad.doubleclick.net"), the Cookie's validity (duration) period and a "value".

The processing is based on our legitimate interest in accordance with Article 6 (1) (f) GDPR (analysis, optimisation and economic interest in the design of our online shop).

You can use the POLO Bike database to save your bike(s) and get more specific offers based on it.

Visitor with a customer account

If you are logged in as a customer, you can store and manage (create, edit and delete) up to five bikes independently in your account. We store the data in our customer database for your customer account. In addition, a cookie is stored on your device, in which the stored bikes are saved. The cookie does not include any personal data, but only the bike you have saved (manufacturer / type / model). This allows us to always show you the right parts for your bike, even without being logged into the online shop. In addition, we can use this Cookie to provide you with fitting offerings for your bike outside of the Webshop. You can set your web browser such that cookies are disabled and not saved.

Visitor without a customer account

If you use our bike database as a non-logged in visitor, a cookie is set for 365 days. This allows us to always display the fitting parts for your bike without customer login.       1. Using WhatsBroadcast

To communicate our offers via WhatsApp we use the WhatsBroadcast service provider platform. Your mobile number will only be used for the purposes of message marketing and will not be shared with WhatsBroadCast ( www.whatsbroadcast.com/de/datenschutz/) or any third party.

The registration for the WhatsApp newsletter takes place via a so-called DoubleOptIn procedure, in which the customer gets registered by entering his or her mobile phone number and the notification subscription starts by sending an additional message.
